About us and our approach to Privacy
Nintendo of Canada Ltd. ("Nintendo Canada") recognizes the importance of protecting the privacy of personally identifiable information ("Personal Information") collected about you, our customers, prospective customers and gaming enthusiasts. Personal Information includes your e-mail address, residential address, home phone number, age, cellular phone number, credit card # and date of birth. Personal Information does not include the name, business title, address, phone or fax number of an employee of an organization. We have adopted a corporate-wide privacy policy that guides how we collect, store, maintain, use and disclose Personal Information about our customers, prospective customers and gaming enthusiasts who show an interest in our products and in our company. Our intent is to balance our legitimate business needs in collecting, storing, using and disclosing this information against your reasonable expectations of privacy and, in doing so, comply with the provisions of the Personal Information Protection Act (British Columbia) and the Personal Information Protection and Electronic Documents Act (Canada).

Why Do We Gather Information?
Personal Information is typically collected and used by us in the conducting of our business, namely the marketing of hardware and software for Game Boy Advance®, NINTENDO GAMECUBEtm and other NINTENDO® devices and accessories.

It is our goal to provide our customers with the highest quality products. In order to process our customers' purchases, to provide our customers and prospective customers with product information and to ensure that our customers receive quality products and customer services, we collect certain Personal Information directly from our customers.

Furthermore, to provide you with a unique and personalized Internet experience and ensure that you receive information from us that is specific to your needs and interests, we may collect certain Personal Information from you when you access and use our web site. Collection of Personal Information
We will notify you as to the types of Personal Information we intend on collecting about you as well as the uses we intend to make of that Personal Information. We do not use techniques that collect Personal Information about you without your knowledge.

Whenever practical, we collect information directly from the individual concerned. In some instances, however, we verify information and obtain information from certain of our business partners.

If you are under 13 years of age, you should not provide any Personal Information without the knowledge and permission of your parent or guardian. Certain products or activities may be unavailable to persons under the age of 13 without the verifiable consent of their parent or guardian.

Use of Personal Information
We use Personal Information in accordance with the consent provided by the individual to whom the information relates, in accordance with this Privacy Policy, our contractual rights and obligations and the law. We may seek to obtain such consent at the time of collection of the Personal Information in question or we may seek to obtain your consent for additional purposes after the collection or receipt of such Personal Information. Personal Information shall not be used by Nintendo Canada employees and representatives for purposes other than as required in the performance of their employment duties.

Consent
We do not collect any Personal Information about you unless you choose to provide that information to us. For example, by purchasing a product or service, submitting a warranty card, participating in our contests or visiting our website, you will be providing us with certain Personal Information which relates to you. Likewise, we do not use and disclose your Personal Information to anyone unless we have obtained your prior consent to do so.

At certain times, however, we may ask you to provide Personal Information that will enable us to provide you with product information, complete a transaction, allow us to provide you post-sale services, enhance your use of our website, offer you certain marketing materials or provide you with notice of certain contests. Likewise, at certain times, it may be necessary for us to ask you to allow us to disclose your Personal Information to one of our business partners. Some of our products are offered or are delivered with the assistance of our business partners and, accordingly, we sometimes disclose to such business partners such information as may be necessary to offer you the products you have requested. Your compliance to such requests is completely optional. You may, decline to consent, or revoke your consent, to the collection and use of your Personal Information for these business purposes but if you do, we may be unable to offer you certain products, allow you to participate in certain activities or complete certain transactions which, by there very nature, require that we use your Personal Information or disclose it to our business partners.

In obtaining consent to the collection, use and disclosure of Personal Information, the purpose for which information is collected, used or disclosed is either obvious by the very nature of the transaction or if not, we state the purpose, either at or before the time the information is collected. For example, we need to collect and store your name, address, and other basic Personal Information to provide you with the service or product you requested, for billing purposes and for post-sale services. When we do collect Personal Information, we collect only that Personal Information which is necessary to such obvious or stated purpose.

We sometimes also use Personal Information to enable us to develop and customize products to better meet your needs and preferences and to offer you Nintendo products and products from our business partners that may be of interest to you. As well we may also collect and use Personal Information for marketing purposes, such as identifying and communicating with individuals who are most likely to find our products of interest. Your consent to this collection and use of your Personal Information is voluntary. You may opt not to have us collect and use your Personal Information for marketing purposes. If you do this, we will collect and use your Personal Information strictly for our business purposes and in accordance with our contractual rights and obligations, but we will not use your Personal Information for marketing purposes. You will not receive offers for additional products, invitation to participate in activities, special offers and promotional mailings, directly from us.

Accuracy of Your Personal Information
Nintendo Canada maintains procedures to ensure that the information we collect and use is accurate, up-to-date, and as complete as possible. However, we rely on you to disclose all material information to us and to inform us of any changes. You may, with proof of entitlement, request to access and if applicable request that we correct information in our possession. You may make this request by writing to our Privacy Officer at the address set out below in the section called "Contacting the Nintendo Privacy Officer for Canada".

Safeguarding Your Information
We apply appropriate safeguards to our computer networks and physical files and we restrict access to Personal Information about you to those Nintendo Canada employees who need to know that information in order to provide you with the products or activities you purchased or requested information about. We also ensure that any business partner to whom we have disclosed Personal Information implements similar safeguards.

Disclosure of Personal Information
Nintendo Canada sometimes retains one of its business partners to perform on its behalf, certain functions in support of the products Nintendo Canada provides and the activities Nintendo Canada organizes. Such functions could include the operation of a support hotline or e-mail support service, game counselor services, warranty services and other similar services. Accordingly, in certain instances these business partners will be provided with Personal Information to the extent that it is necessary in the performance of those specific services. Nintendo Canada obligates our these business partners to use and take steps to protect Personal Information and impose restrictions on their use and disclosure of Personal Information in accordance with the requirements of this Privacy Policy.

We do not sell our customer lists or other Personal Information.
From time to time, we are approached by companies and organizations that produce a product or service that we believe may be of interest to you. We see this as a value?added service helping you to find products that meet your particular needs and preferences. We will offer you the opportunity to "opt-out" of having your Personal Information shared with third parties. Your consent to the disclosure of your Personal Information to our business partners for the purpose of offering you additional products is optional. You may decline or revoke your consent to this optional disclosure of your Personal Information by contacting writing to the address provided below in the section called "Contacting the Nintendo Privacy Officer for Canada". If you do this, you will not receive offers of additional products, invitations to participate in activities, special offers and promotional mailings, directly from our business partners.

We also share information where permitted or required by law, or at the request of government regulators.

Retention and Access to Your Personal Information


We retain Personal Information only for so long as is necessary to fulfill the purpose for which it was collected and to meet our legal and contractual obligations. If Personal Information is no longer required, it will be destroyed or rendered anonymous. Given the nature of our business and the post-purchase services we provide, where necessary, some of the information we collect for business purposes is kept indefinitely.

If you have a right of access, you or a person authorized in writing to act on your behalf may, with satisfactory identification and proof of entitlement, request access or, if applicable, request a correction of your Personal Information which Nintendo Canada has in its possession.

The right to access is not absolute. For example, you do not have a right to access and we may decline your request for access, if the information requested is subject to a legal privilege.

We may charge a reasonable fee in advance for copying and sending information you have requested and to which you have a right of access.

Security
We will maintain appropriate safeguards to ensure the security, integrity and privacy of Personal Information. If you have provided us with Personal Information which is particularly "Sensitive", we will protect that information with extra care. We define Sensitive Data as including Social Insurance Numbers, mother's maiden name, personal financial data such as salary?specific information, net worth, annual income, credit card number and most information about children.
